Workers' Compensation

North Carolina Workers' Compensation Lawyers
Serving North Carolina, Including Greenville, Jacksonville, Kinston, New Bern, Raleigh, and More.

At Whitley, Rodgman & Whitley, LLP, our workers' compensation lawyers handle claims for people sustaining on-the-job injuries in North Carolina. If you have suffered an injury arising from your employment, or what is called an "occupational disease" that resulted from your work, you may be able to file a workman compensation claim.

Workers' compensation can pay for medical bills resulting from the injury or disease, wages lost to the injury, and any costs arising from a permanent disability. Agreeing to workers' compensation also prevents you from being able to sue your employer.

If you have good reason to believe that your employer intentionally harmed you or made working conditions that he or she knew would probably cause injuries such as the one you are suffering from, you probably should not file a workers' compensation claim. You should file a personal injury lawsuit instead. Under most circumstances, however, a workers' comp claim is the best way to get the money you need.

Changes in North Carolina workers' compensation laws.

Currently, North Carolina has good workers' compensation laws, but the Senate is trying to change them drastically in Senate Bill 984. In our Lawyers On Call segment on WITN Channel 7, we are trying to publicize the effects this bill will have. In this article you can get a good summary of those changes.

How do you file a workers' compensation claim?

Within 30 days of the incident that caused the injury, you must tell your employer, in writing, about the injury. Then you must file a Form 18 with the North Carolina Industrial Commission within 2 years of the incident.

For more information about workers' compensation, please visit our Frequently Asked Questions about Workers' Compensation page.

The best way to give you the information you need, however, is to speak with you personally. If you contact us or call 1-800-785-5000 and explain your situation and injury, our attorneys can give you personalized legal advice and help you through the process. We offer free initial consultations and work on contingency, meaning that we charge no fees until we get you compensation.

Our attorneys have law offices throughout Eastern North Carolina, including Kinston, Raleigh, New Bern, Greenville, and Jacksonville. We are here to help the people of Wilmington, Goldsboro, Pitt County, Onslow County, Craven County, Wake County, Lenoir County, Wayne County, and more.
